Download Free The Law of the Police PDF by Rachel Harmon Full Book and published by Aspen Publishing. This book was released on 2021-01-31 with total page 944 pages. Available in PDF, EPUB and Kindle. Book excerpt: This important new book provides materials and analysis for law school classes on policing and the law. It offers a resource for students and others seeking to understand and evaluate how American law governs police interactions with the public. The book provides primary materials, including cases, statutes, and departmental policies, and commentary and questions designed to help readers explore policing practices; the law that governs them; and the law’s consequences for the costs, benefits, fairness, and accountability of policing. Among other issues, the notes and questions encourage readers to consider the form and content of the law; how it might change; who is making it; and how the law affects policing. Part I introduces local policing—its history, its goals, and its problems; Part II considers the law that regulates criminal investigations; Part III addresses the law that governs street policing; and Part IV looks at policing’s legal remedies and reforms. Professors and students will benefit from: Chapters and notes designed to allow flexibility—allow professors to assign materials selectively according to the needs of the course. As a result, the casebook can serve as materials for a range of lecture and discussion-based courses on the law regulating police conduct; on legal remedies and reforms for problems in policing; or on more specific topics, such as the use of force or constitutional rules governing police conduct. Descriptions of controversial policing encounters and links to and discussion of videos of such incidents—help students practice applying the law, consider its policy implications, and gain awareness of contemporary controversies on policing. Diverse primary materials, including federal and state cases and statutes and police department policies—provide a broad exposure to the types of law that govern public policing. Photos, links to videos, protest art, and charts—pique student interest, enable richer discussions, and provide additional context for legal materials in the book. Integration of scholarly work on policing, on the law, and on the impact of police practices—enables students to make more sophisticated assessments of the law. Notes and questions—designed to (a) highlight alternative strategies lawyers might use to change the law, and (b) raise comparative institutional questions about who is best suited to regulate the police. Discussion of legal topics relevant to contemporary discussions of policing—studied nowhere else in the law school curriculum.

Book excerpt: Although far from a typical raid, the 20 July Plot – Operation Valkyrie – was still a daring and audacious attack undertaken by a small, very brave, group of individuals, determined to kill Hitler. Hitler was badly shaken by the blast and, despite the fact that numerous other attempts had been made on the Führer's life since he came to power, the July 20 Plot has achieved an almost mythic status. Numerous books, both factual and fictional, have been written on the subject. There have been several TV dramatisations and reconstructions, including a MythBusters production which considered whether or not the attempt would have been successful if the bomb had been planted in Hitler's bunker. German resistance to Hitler has also been depicted on film, most notably by James Mason in The Desert Fox and more recently by Tom Cruise in Valkyrie, an accurate and acclaimed version of the July 20 Plot.

Book excerpt: The last member of Operation Valkyrie - the daring July 20 1944 plot to assassinate Hitler - tells his remarkable story. 'It was not the question of an isolated assassination, but rather of beginning a complete overthrow of the regime' July 20 1944. A fearless group of German officers attempted to act against the horrors of Nazism and put an end to the war by killing Adolf Hitler. But Operation Valkyrie failed, and one by one the plotters were found out, tortured and executed. Philipp von Boeselager - who supplied the explosives that would rip through the Führer's bunker - miraculously escaped death. In this unique memoir Philipp tells his extraordinary life story and the part he played in this, and three other dramatic attempts on Hitler's life. He recounts how a small band of resisters dared to stop evil and prevent profound loss of lives. Ultimately they failed but the legacy of their courage endures.

Book excerpt: 'It is now time that something was done. But the man who has the courage to do something must do it in the knowledge that he will go down in German history as a traitor. If he does not, however, he will be a traitor to his own conscience' Colonel Claus von Stauffenberg, July 1944 The July 1944 Plot to kill Adolf Hitler was a desperate attempt by a group of senior officers to redeem Germany's honour and end the Second World War. They were heroic because they knew their chances of success were slight and that the result of their failure would undoubtedly be a terrible death. They wanted to leave a message for later generations: that there were Germans who understood the evils of Nazism and were willing to act against it. This extraordinary story is the basis for Bryan Singer's major new film Valkyrie, due to be released in February 2009. Published for the first time as a separate book, Luck of the Devil is taken from Ian Kershaw's bestselling Hitler 1936-1945: Nemesis and is a brilliant account of just what happened in those fateful days at Hitler's Wolf's Lair headquarters, when his opponents came so astonishingly close to assassinating what is one of the modern era's most terrible figures.

Available in PDF, EPUB and Kindle. Book excerpt: The Heider family huddles together in the basement, wondering if this is the last day they will be together, if this is the last day of their lives. Its Munich, Germany, in 1945, the day American tanks are rolling in. Annelieses father finds a white sheet, ready to hang it from the attic window, hoping he times it right. Too early, and German SS forces could open fire. Too late, and the Allied forces could shoot. Thank god, its not the Russians. And so begins the memoir of Anneliese Heider Tisdale, who grew up in Germany during World War II. Hers is a universal and timeless tale of war and death, of fear and deprivation, of the inventiveness of children who want to dance and wear new clothes but instead have childhoods filled with bandages and bombs, who return to school one fall to find the crucifix in their classroom replaced with a picture of the Fhrer.

Available in PDF, EPUB and Kindle. Book excerpt: 20 July 1944 is usually associated with the bomb plot to murder Hitler. However, what distinguishes Colonel Stauffenberg’s plan from all others is that the attempt on the Führer’s life was only to be the initial stage of a full military coup d’état. The aim was to overthrow the murderous regime, and to end the war as soon as possible. The conspiracy has long been analyzed from political, social, religious, or moral points of view. This book asks what the military dimension of the plan was. What traditions in the German army were at work, how was planning and preparation done, and why did the plot fail eventually? What is more: how did the conspiracy affect the German armies created in East and West after World War II, and also the Austrian Army? As the politicians among the conspirators thought in categories of Imperial Germany or at least the Weimar Republic, the officers among them were conditioned by the Reichswehr. Yet, Stauffenberg and some others were also bright intellectuals who were willing to incorporate their war experience into their plans, rendering them surprisingly modern at times. The coup d’état had been planned as meticulously as circumstances in war-torn Berlin allowed. However, as most officers had foreseen, once it became public knowledge that Hitler had survived Stauffenberg’s bomb, army units refused to act. The myth surrounding the "Führer" effectively prevented any military action against him. Still, the failed uprising had its effects: the regime took the opportunity to tilt the balance of power further in favor of Himmler and his fiefdom (SS, Gestapo, Police), to the detriment of the army which Hitler felt was too reactionary anyway. The leadership of the West German Bundeswehr always saw the failed uprising as part of its tradition, but it took time for this attitude to percolate down to the rank and file. For decades, some of the former Wehrmacht soldiers viewed Stauffenberg and his friends as "traitors". The book is the first to approach this important event in German history from a specifically military point of view, and that results in some surprising new results.

Book excerpt: What we believe and what we do not believe has a great impact on what we do and fail to do. Hence, if we want to act responsibly, we should believe responsibly. However, do we have the kind of control over our beliefs that such responsibility for our beliefs seems to require? Do we have certain obligations to control or influence our beliefs on particular occasions? And do we sometimes believe responsibly despite violating such obligations, namely because we are excused by, say, indoctrination or ignorance? By answering each of these questions, Rik Peels provides a theory of what it is to believe responsibly. He argues that we lack control over our beliefs, but that we can nonetheless influence our beliefs by performing actions that make a difference to what we believe. We have a wide variety of moral, prudential, and epistemic obligations to perform such belief-influencing actions. We can be held responsible for our beliefs in virtue of such influence on our beliefs. Sometimes, we believe responsibly despite having violated such obligations, namely if we are excused, by force, ignorance, or luck. A careful consideration of these excuses teaches us, respectively, that responsible belief entails that we could have failed to have that belief, that responsible belief is in a specific sense radically subjective, and that responsible belief is compatible with its being a matter of luck that we hold that belief.

And the leader of the assassination plot, Colonel Claus von Stauffenberg, is the new Chancellor of Germany. Stauffenberg unleashes Germany’s wonder weapons, the Messerschmitt 262 jet fighter, the Arado 234 Blitz Bomber, and the Type 21 super submarine. But it may be too late. The massive Soviet army is marching relentlessly to the west. And the Americans and British are bombing Germany day and night, wrecking its war machine, killing hundreds of thousands, and paving the way for an invasion in 1944. Germany is running out of time. But it still has one super weapon left, and that’s the atomic bomb, originally approved by Hitler in 1934 but abandoned by him in 1940. Professor Werner Heisenberg and his team of nuclear scientists, now decimated by Hitler’s anti-Jewish hysteria, are Germany’s only hope. Can Germany snatch victory from the jaws of defeat by unlocking the secrets of the atomic bomb before the scientists of the Manhattan Project? Can this terrible weapon be used against the Americans and the British to force them out of the war, and then smash the Soviet Union? Can Hitler’s dream of a thousand-year Reich be achieved even as his ashes lie at the bottom of a lake on the outskirts of Berlin?
