This book was released on 2009-04-10 with total page 366 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the constitutional principles governing the relationship between legislatures and courts at that critical crossroads of their power where legislatures may seek to intervene in the judicial process, or to interfere with judicial functions, to secure outcomes consistent with their policy objectives or interests. Cases of high political moment are usually involved, where the temptation, indeed political imperative, for legislatures to intervene can be overwhelming. Although the methods of intervention are various, ranging from the direct and egregious to the subtle and imperceptible, unbridled legislative power in this regard has been a continuing concern in all common law jurisdictions. Prominent examples include direct legislative interference in pending cases, usurpation of judicial power by legislatures, limitations on the jurisdiction of courts, strategic amendments to law applicable to cases pending appeal, and attempts directly to overturn court decisions in particular cases. Because the doctrine of the separation of powers, as an entrenched constitutional rule, is a major source of principle, the book will examine in detail the jurisprudence of the United States and Australia in particular. These jurisdictions have identical constitutional provisions entrenching that doctrine as well as the most developed jurisprudence on this point. The legal position in the United Kingdom, which does not have an entrenched separation of powers doctrine, will be examined as a counterpoint. Other relevant jurisdictions (such as Canada, Ireland and India) are also examined in the context of particular principles, particularly when their respective jurisprudence is rather more developed on discrete points. The book examines how the relevant constitutional principles strive to maintain the primacy of the law-making role of the legislature in a representative democracy and yet afford the decisional independence of the judiciary that degree of protection essential to protect it from the legislature's 'impetuous vortex', to borrow the words of James Madison from The Federalist (No 48).

Available in PDF, EPUB and Kindle. Book excerpt: Written using official records and other sources, British Rule in China is the first systematic account of the legal history of Weihaiwei, a small territory leased by China to Britain in 1898. It is a fascinating and accessible account of the territory's constitution, laws, courts, judges and magistrates, penal policy, and police force. The book explores the various problems and controversies faced by the local authorities in administering justice as well as their attempts to resolve them. This is the first work to examine thoroughly, through research into the law, the history of Weihaiwei under British rule. Whilst looking also at the legal status of Weihaiwei, its laws and institutions, this work also pays attention to particular aspects of the legal system which had the greatest impact on the lives of the ordinary villagers in this part of China. Based on extensive research of primary sources, British Rule in China is a fascinating and readable account of a legal system and the response of the territory's Chinese residents to it. Book excerpt: This is a study of two topics of central importance in late medieval history: the impact of war, and the control of disorder. Making war and making law were the twin goals of the state, and the author examines the effect of the evolution of royal government in England and France. Rangingbroadly between 1000 and 1400, he focuses principally on the period c.1290 to c.1360, and compares developments in the two countries in four related areas: the economic and political costs of war; the development of royal justice; the crown's attempt to control private violence; and the relationshipbetween public opinion and government action. He argues that as France suffered near breakdown under repeated English invasions, the authority of the crown became more acceptable to the internal warring factions; whereas the English monarchy, unable to meet the expectations for internal order whicharose partly from its own ambitious claims to be `keeper of the peace', had to devolve much of its judicial powers. In these linked problems of war, justice, and public order may lie the origins of English `constitutionalism' and French `absolutism'.

Available in PDF, EPUB and Kindle. Book excerpt: Henry the Navigator is a legendary, almost mythical, figure in late medieval history. Together with Columbus he was considered one of the progenitors of 'modernity', a man who dared to challenge the scientific assumptions of his age and by so doing was responsible for liberating Europeans from the geographical constraints which had bound them since the collapse of the Roman Empire. His image as imperialist and, above all, maritime, mathematical, and navigational pioneer has been slow to die. Yet there has been no English life of this 'hero of both science and of action' since Beazley's of 1895. This book, therefore, represents the first re-evaluation of his life in over a century. Peter Russell has made use of much recently published documentary evidence to provide an eloquent, sophisticated and highly readable account of Henry's life. While full attention is given to all aspects of his voyages of discovery in the African Atlantic, including their economic and cultural consequences and the difficult questions of international law and papal jurisdiction, Russell also examines in detail the other spheres of activity which contributed to his fame, or sometimes brought it into question
